By accessing or using Duende ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

The AI guides within Duende are not licensed therapists, psychologists, psychiatrists, or healthcare providers. Nothing in Duende constitutes medical advice, diagnosis, or treatment. Duende is not a substitute for professional mental health care.
If you are experiencing a mental health emergency, suicidal thoughts, or immediate danger to yourself or others, please contact emergency services (911) or a crisis line such as the 988 Suicide and Crisis Lifeline immediately. Do not rely on Duende for crisis support — we cannot monitor conversations in real time and cannot guarantee intervention in crisis situations.
You must be at least 18 years old to use Duende. By using the Service you represent that you are 18 or older.
You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately at hello@duende.health if you suspect unauthorized access.
Duende offers your first three sessions free. Continued access after that requires a paid subscription. Subscriptions are offered at $39 per month or $349 per year, as selected at signup, and are processed through our payment provider, Stripe. Your subscription renews automatically at the end of each billing period — monthly or annual — unless you cancel before the renewal date. You can cancel at any time through your account settings; cancellation stops future renewals, and you keep access through the end of the period you have already paid for. We do not provide refunds for partial billing periods.
The responses generated by Duende's AI guides are produced by artificial intelligence and do not represent the views of Duende Health LLC. AI responses may occasionally be inaccurate, incomplete, or inappropriate. Use your own judgment when considering anything the Service produces. Duende does not monitor conversations in real time.
You retain ownership of the content you create in Duende, including your messages, journal entries, and intake responses. By using the Service, you grant Duende Health LLC a limited, non-exclusive license to store, process, and transmit that content solely to operate and provide the Service to you — including generating the responses, summaries, and continuity features described in our Privacy Policy. We do not claim ownership of your content, sell it, or use it for advertising.
You agree not to use Duende to harm yourself or others, to attempt to extract harmful information, to impersonate others, or to use the Service for any unlawful purpose.
We reserve the right to suspend or terminate your account if you violate these Terms or use the Service in a way that puts others at risk.
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted or error-free, or that the AI guides' responses will be accurate, complete, or suitable for your particular circumstances. Your use of the Service is at your own discretion and risk.
To the maximum extent permitted by law, Duende Health LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the three months preceding the claim.
We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms.
These Terms are governed by the laws of the State of Delaware.
